Graham challenges subpoena in Georgia 2020 election grand jury probe

U.S. Sen. Lindsey Graham (R-SC) is challenging a subpoena to testify before a Georgia special grand jury probing whether former-President Donald Trump and others broke the law by attempting to overturn President Joe Biden’s win in the state.

Graham, who has close ties to Trump, received a July 26-issued subpoena ordering him to appear before the special grand jury to testify on Aug. 23; his lawyers said in a court filing reported by FOX 5 Atlanta.

The senator is seeking to have the challenge to the subpoena heard in federal court in Atlanta rather than before the Fulton County Superior Court judge who is overseeing the special grand jury, the report said. 

Graham is just one of Trump’s associates who Fulton County District Attorney Fani Willis hopes to question in her investigation into what she calls a “multi-state, coordinated plan by the Trump Campaign to influence the results of the November 2020 election in Georgia and elsewhere,” the FOX 5 report said

In a court filing last month, Willis referenced at least two telephone calls made by Graham to Georgia Secretary of State Brad Raffensperger and members of his staff in the weeks following Trump’s loss to Biden, the report said. In the calls, he was said to have asked about re-examining certain absentee ballots, aiming to “explore the possibility of a more favorable outcome for former President Donald Trump."

Although lawyers for the senator claim Willis failed to demonstrate the “extraordinary circumstances” in place to order such a high-ranking federal officer to testify, Willis’ office expects Graham to testify before the special grand jury; the FOX 5 report said.
